Do you know of a case where a buyer has been held liable for commission to RE agent when contract affirmatively provides for buyer to pay in the event of buyers default?
  A:
Thanks for your question. I don't recall seeing such a case, but see no reason that a court would not enforce a provision that clearly makes a broker a third party beneficiary of a real estate sales contract.
