RESIDENTIAL DISCLOSURE

Recently after looking at a house the first time, a purchaser commented to her realtor that she wondered if the previous owner had died in the home (she knew she was deceased). The realtor replied that they would have to disclose it if she had. After purchasing the home the purchaser found out that the woman had indeed died in the home. Now the realtor says there is not such law anywhere in the country that she knows of. I am almost positive that I had heard on the news in the past year or so that there was a nationwide disclosure law that it had to be made known to a prospective buyer that someone had died in the house. Is there any truth to that?

I am unaware of a statute like the one you describe and note that T.C.A. § 66-5-207 provides that owners and realtors are not liable for failing to disclose occurrences that have no effect on the physical condition of a house.
