| Q: | Developer wishes to record a master deed for a condominium project pursuant to TCA 66-27-103. The project totals 36 units in six buildings. The land area to be dedicated is six acres. The developer wants to file a site plan for two buildings located on two acres and show the remaining four acres as reserved for future development. At a later date, the developer will file a supplemental or amended site plan showing the location of the buildings and area of the units. TCA 66-27-107 requires the Master Deed and Plat or any combination thereof to show the building locations and unit areas. Does identifying the building locations and unit areas in phases violate TCA 66-27-103 or TCA 66-27-107? |

| A: | I think it's fine to start with the two acres and the two buildings (showing the building and unit locations) and provide in the master deed that it can be amended to add the other four acres and the buildings to be constructed thereon. Of course, the amendment should show building and unit locations on the four acres. |
