SUBJECT/TOPIC:
EASEMENTS
  Q:
What is the law pertaining to right of way if it is the only way to reach your property?
  A:
If the land over which access is sought and the subject property were once part of the same parcel, an easement by necessity or an easement by implication may exist. What I think you probably have in mind, however, is a suit to condemn a private road. For the law on that see TCA 54-14-101, et seq.
